Terms of Service

These Terms of Service ("Terms") govern your access to and use of JobTally (the "Service"), operated by Pierre Lamey, entrepreneur individuel (France) (the "Operator", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

JobTally lets small service businesses create quotes and invoices, share payment links with their clients, and track payments. The Service is provided for business (B2B) use, not for consumers.

2. Accounts

You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity under your account. You must be legally able to enter into contracts and use the Service only for a lawful business activity.

3. Free trial, subscriptions, and billing

• New accounts get a 14-day free trial with full access. No payment method is required to start the trial.
• After the trial, a paid subscription (billed monthly through Stripe) is required to create or send new invoices. Your data remains accessible in read-only form if you don't subscribe.
• Subscriptions renew automatically each month until cancelled. You can cancel at any time from the billing portal in Settings; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
• Prices may change with at least 30 days' notice.

4. Payments between you and your clients

Card payments made by your clients on invoice pay links are processed by Stripe through your own Stripe account (Stripe Connect). Funds flow directly from your client to your Stripe account: we never receive, hold, or transmit those funds, and we are not a party to the transaction between you and your client. Your use of Stripe is subject to the Stripe Connected Account Agreement. You are solely responsible for the goods and services you sell, your invoices' accuracy, applicable taxes (including VAT/sales tax), and any refunds or disputes with your clients.

5. Your content and data

You retain all rights to the data you enter into the Service (clients, quotes, invoices). You grant us the limited rights needed to host, process, and display that data in order to provide the Service. You can export your data (CSV) at any time. You are responsible for having a lawful basis to enter your clients' contact details into the Service; for that data we act as a processor on your behalf (see the Privacy Policy).

6. Acceptable use

You agree not to:

• use the Service for anything unlawful, fraudulent, or misleading (including fake or deceptive invoices);
• violate Stripe's prohibited business lists or applicable payment rules;
• attempt to breach, probe, or overload the Service's security or infrastructure;
• resell or provide the Service to third parties as your own offering.

7. Intellectual property

The Service, including its software, design, and branding, is owned by the Operator or its licensors. These Terms grant you no rights other than the right to use the Service while your account is in good standing.

8. Availability and changes

We aim for high availability but do not guarantee uninterrupted operation. We may modify features, and may discontinue the Service with at least 60 days' notice, during which you can export your data.

9. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. JobTally is not accounting, tax, or legal advice; invoices generated with the Service may need adaptation to your local invoicing requirements.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages, loss of profits, or loss of data, nor for disputes between you and your clients. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Termination

You may delete your account at any time by contacting us. We may suspend or terminate accounts that materially breach these Terms, with notice where practicable. Upon termination we will make your data available for export for 30 days, after which it may be deleted.

12. Governing law

These Terms are governed by French law. Any dispute that cannot be resolved amicably will be submitted to the competent French courts, without prejudice to mandatory rules of jurisdiction.

13. Changes to these Terms

We may update these Terms; material changes will be announced by email or in the app at least 30 days before they take effect. Continued use after that date constitutes acceptance.
